Eminent Domain

* Boston Edison v. MWRA. Along with Jeffery Tocchio, Esq. of Drohan, Tocchio, & Morgan, P.C., Mr. Bourbeau obtained an $11 million jury verdict in an eminent domain case against the Massachusetts Water Resources Authority on behalf of a major utility company, more than tripling the amount offered by the taking authority for land taken for a sewer pump station and associated facilities, which were constructed on the site where a 750MW electric generating plant was also being constructed. This case involved an extremely complex eight week jury trial, believed to be the longest Superior court Civil trial in Norfolk County history. This was the 4th largest jury verdict statewide in Massachusetts in 2007.

Storage Equities II v. MBTA: Mr. Bourbeau obtained a $3.55 million jury verdict in an eminent domain case against the Massachusetts Bay Transportation Authority on behalf of a national self-storage operator, more than doubling the amount offered by the taking authority for land taken for a commuter rail station. This was the 10th largest jury verdict statewide in Massachusetts in 1998.

Shamrock Inc. v. City of New Bedford: We obtained a $1.27 million jury verdict in an eminent domain case against a city for woodland taken for a refuse landfill, where the city had offered the landowners only $43,000. This was the 26th largest verdict statewide in Massachusetts in 1998.

Mashpee Village Ltd. Partnership v. Mashpee Water District: Obtained a $1.6 million settlement for land taken for a public water supply where the defendant agency had offered the landowners only $30,000.

* We obtained $245,000 for the operator of an electronic component factory in an action against the Massachusetts Bay Transportation Authority for damages arising out of the vibrational impact of a new commuter rail track near the owner’s property, after demonstrating that the sound and vibrations made by the trains would affect the owner's high technology use.

* We obtained a $900,000 settlement for the owner of a cranberry bog for damages resulting from the drawing down of groundwater by a nearby city.

* We brought suit on behalf of a landowner whose deeded beach rights were taken by a town for use as a public boat launch, seeking both loss of the private beach and damage to the owner's remainding land as a result of having a public boat launch adjacent to a beach house. The jury awarded 100% of our client’s claim.

Business Litigation

*We sucessfully represented a Large Automobile Dealership in a lawsuit against a major bank.

* We succesfully represented the seller of a Large Automobile Dealership in a suit brought by the Buyer, obtaining ia judgment that resulted in a substantial settlement payment from that Buyer.

Medical Malpractice

* We obtained a $700,000 medical malpractice settlement for family of a 69-year-old woman who died when her gastroenterologist allegedly failed to diagnose her intestinal eschemia.

Labor/Employment

* We successfully defended the non-union cleaning contract company of a high rise office building in Hartford, CT, in a union brought Unfair Labor Practice claim before the National Labor Relations Board (NLRB), saving the client hundreds of thousands of dollars in pay claims.
